ACCIDENT WAIVER AND RELEASE OF LIABILITY

I acknowledge that MogollonMonster.com activivities are a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather conditions, environment, equipment, vehicular traffic, lack of hydration, animals and actions of other people; including but not limited to, participants, non-participants, volunteers, spectators, instructors, and/or guides.  I hereby assume all of the risks of participating and/or volunteering in these events. I realize that liability may arise from negligence or carelessness on the part of the persons or entities being released from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently trained for participation in these events, and have not been advised otherwise by a qualified medical person.

I acknowledge that the activity organizers in which I may participate will use this Accident Waiver and Release of Liability (AWRL) form; and that it will govern my actions and responsibilities at said activities.

In consideration of my application, and permitting me to participate in these events; I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) Waive, Release, and Discharge from any and all liability for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter accrue to me or my traveling to and from this event; THE FOLLOWING ENTITIES OR PERSONS: MogollonMonster.com their directors, officers, employees, volunteers, representatives, and agents, the event holders, event sponsors, event directors, event volunteers; and (B) Indemnify and Hold Harmless the entities or persons mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of any of my actions during these events.

I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during these events.

Any act of failure to abide by this AWRL agreement is a dishonorable act on my part and is a breach of friendship, my word, and contract which may result legal prosecution. 

This AWRL shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

PARENT GUARDIAN WAIVER FOR MINORS (Under 18 years old)

The undersigned parent, and natural guardian or legal guardian, does hereby represent that he/she is, in fact, acting in such capacity, and agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act; and release said parties on behalf of the minor and the parents or legal guardian.

Dear Sir/Madam:

1.  In consideration of you arranging to film and record the contribution to be give by me to you on ___________(date) and for other valuable consideration the receipt and sufficiency of which I acknowledge, I agree to the recording and broadcasting of the contribution an hereby give all consents necessary of the reproduction, exhibition, transmission, broadcast, publishing, previewing, reviewing and exploitation of the contribution without time limit  through the universe by all means and media (whether now known or hereafter invented) without liability or acknowledgement to me.
2. This agreement shall be a “work-made-for-hire” pursuant to the United States Copyright Act and consequently I  hereby irrevocably assign to you the entire copyright and all other rights in and to my contribution (and where any such contribution is not in existence at the date hereof, by way of present assignment of future copyright), throughout the universe for the full period of copyright and all renewals and extensions thereof, and thereafter for the maximum period permitted by law in any media hereafter devised.

I hereby waive unconditionally and  irrevocably the benefit of any provision of law known as “Moral Rights” or similar laws now or hereafter prevailing in any part of the world which might otherwise apply to my contribution, and I will not assert any Moral Rights against you, MogollonMonster.com and associated owners, officials, employees, or participants.  I agree that you shall be entitled to cut, edit, and translate the contribution as you deem fit and you shall not be obliged to include all or any of the contribution in any programs. 

1.  I irrevocably agree to defend, indemnify and hold you MogollonMonster.com harmless from and against any claim (including but not limited to claims arising from negligence or misconduct),, loss, penalty, liability, cost and expense, including without limitation reasonable legal costs and attorney’s fees arising out of (1) any actual or threatened breach of agreement, warranty, representation or undertaking made by me in this agreement and/or undertaking made by in in this agreement and/or any of the and (2) and my preparation for, participation and appearance, or voluntary withdrawal or the activities associated with the programme.
2. Any and all information disclosed or obtained by me concerning or relating to the Programme, the participants, the events contained in the Programme, the outcome of the Programme, my participation in the Programme, you, MogollonMonster.com and terms and conditions of this agreement shall be strictly confidential.
3. I agree that my contribution will be true and honest.  I confirm that I have no pre-existing medical condition which would increase t he risk to injury to myself or others as a result of my participation in the Program. 
4. I agree –

(a)      That I have the right to enter into this agreement and grant the rights therein, and do so freely and with sound mind and body.

(b)     That anything I contribute to the Program will be an  honest and truthful account of my experience

(c)      That I have not misled you in any way as to my identity, experience, knowledge, or as to the nature and/or content of my contribution to the program.

(d)     That in entering this agreement I am not relying upon any statements or promises made by anyone regarding the program, my participation in it, or the terms of this agreement.

1.  I understand you have relied on the granting of this release by me and will incur substantial expense based upon such reliance. 
2. I agree that you shall be capable of assigned this Agreement whether in whole or in Part

I hereby release and discharge you from any and all liability arising out of any breach, or any injury of any kind which may be sustained by me from participation in or in connection with the utilization of the program or by reason of the exercise by you of any rights granted to  you hereunder, whether or not said liability results from your negligent acts (active or passive) save and except claims or litigation arising though your sole gross negligence or sole willful misconduct.
4. I agree as a fundamental term of this agreement that my sole remedy for breach by you or your assignees or licensees of nay of their obligations under this agreement shall be an action at law for damages and I an knowledge that such damages are fully adequate to compensate me in the case of any breach by you and your assignees for licensees  hereunder.  In no event shall I be entitled to rescission, injunctive or otherwise equitable relief.
5. I agree that this Agreement shall be non-union and that no collective bargained agreements shall apply
6. I agree that the Agreement shall constitute the entire agreement between you and I and that this Agreement shall supersede all prior negotiations, understandings and agreements (whether written or oral) of the parties hereto relating to t he subject matter herein.
7. This agreement shall be governed by the laws and statutes of the State of Arizona.

MEDIA RELEASE CONCENT, PROPERTY OWNERSHIP, AND NON-DISCLOSURE  AGREEMENT

I understand at official MogollonMonster.com events or related activities, I may be photographed and/or video taped. I agree to allow my photo, video, voice, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers, and/or assigns including but not limited to Internet websites. My image my be used for video documentaries, movies, and viewings, and I will receive no compensation for such use.

I understand I will maintain any copyrights for materials I create during an officially sponsored MogollonMonster.com  event such as photos, video, film, or film likeness, and will provide MogollonMonster.com a copies with license to use such items in commercial and non comercial uses as MogollonMonster sees fit with no compensation for such use.

I understand that as a participant in any MogollonMonster activities, any artificts such as footprint casts, hair, scat, or any other related Bigfoot items will be property of MogollonMonster.com. I will receive full credit for finding such items, but ownership will be by MogollonMonster.com.

I understand the loctions to be invesitgated during the events are confidential, and I promise and hereby give my word of honor, I will not disclose the location of the areas being investigated by MogollonMonster.com to any non-participant/s of the event or other outside agencies. I will not disclose or take any other person/s to these locations without written conscent from MogollonMonster.com. I understand that if I dishonor this agreement and return to the area, or introduce anyone else to the area; that I may be banned from membership, and my name may be published to other bigfoot agencies and on the Internet as a warning to all of such behavior. Any or all artifiacts found or created in MogollonMonster.com research areas such as photos, videos, or video likenesses, hair, footprints, bones or Bigfoot evidence taken during a nonsactioned event will be turned over to MogollonMonster.com with full legal license for use in any way MogollonMonster.com sees fit. Refusal to do so may result in lost of membership and my name may be published to other Bigfoot Agencies and on the Internet as a warning to other parties.
